CARROLL COUNTY, Ind. — Richard Allen’s lawyers want the court to keep jurors from hearing a recorded police interrogation because they say Allen’s civil rights were violated. Allen is suspected of murdering a woman in Delphi.

Allen’s lawyers said in a Motion to Suppress filed Monday in Carroll County Court that their client was never read his Miranda rights before being questioned. They also claim that Indiana State Police officials lied to Allen during the interview.

For killing 13-year-old Abby Williams and 14-year-old Libby German near the Monon High Bridge in Delphi in February 2017, Allen is being charged. His high-profile murder trial is currently scheduled to begin on May 13.

More court dates are coming up, and Allen’s team is now asking that one of the two recorded interviews be thrown out as evidence. Their disagreement is based on what did and did not happen before, during, and after ISP Trooper Jerry Holeman’s recorded interview with Allen.

Court docs show that on Oct. 13, 2022, Allen and his wife drove from Delphi to ISP’s Lafayette Post to get a car that had been seized by troopers 13 days before. However, when they arrived, Allen says he was separated from his wife and taken inside for questioning.

Allen’s lawyers say that ISP Trooper Holeman broke many basic police rules during this interview. For example, they say that Holeman didn’t read Allen his Miranda rights, let him know he could leave at any time, or let him know that the interview was being recorded.

In addition, Allen’s lawyers say that the beginning of the recorded interview either never existed or is no longer there.

“In this case, either (a) the camera wasn’t turned on until several minutes into the interview,” court papers say. “Or (b) the camera was rolling the whole time, but the beginning of the interview was cut out before it was given to the defense.” ”.

In a filing on Monday, both of Allen’s lawyers said that this is “highly unusual” police behavior in the 70 years of experience they have. They also say Allen was kept in the small interrogation room with no windows for more than two hours without being able to leave.

The lawyers are now asking that the recording not be played for the jury in the trial because of these alleged problems with the interview.

Allen denying being involved in the murder, Holeman assuring police that they have expert testimony linking him to evidence, and quotes from the trooper, such as “You’re guilty and I know it and I’m going to f***ing prove it,” would all be lost if they were taken out of the evidence. ”.
